The Portuguese legislation in force, Order 701-G/2008, Article 27, only requires that the digital certificate used to sign documents on electronic contracting platforms be a qualified digital certificate.

<br>

Order 701-G/2008
 +
<br>
 +
Article 27 - Electronic Signature
 +
<br>
 +
1 — All documents uploaded to electronic platforms must be electronically signed via qualified electronic signature certificates.
 +
<br>
 +
2 — For all electronic signature effects, the agencies mentioned on paragraph 3 must use digital certificates issued by a certifying agency of the Electronic Certification System of the State.
 +
<br>
 +
3 - When the digital certificate does not directly relate the signer with its function and power of signature, the concerned agency should submit an electronic document to the platform indicating an official electronic document indicating the power of attorney and signature of the signer.
 +
<br>
 +
As the citizen card is a qualified digital certificate, it can be used to sign documents on electronic platforms. Therefore, you do not have to acquire a qualified representation certificate.
 +
<br>
 +
However, the paragraph 3 of Article 27, Order 701-G/2008 determines that if the digital certificate does not determine the function and power of signature of the signer, it is necessary, each time you use a certificate on those conditions, to attach an official electronic document issued by an official entity or by the legal representatives of the entity that you represent, recognizing powers of attorney to sign documents on behalf of the entity.
 +
<br>
 +
If you have a qualified representation digital certificate, if this certificate incorporates the user power of representation, you don't have to attach any additional document to sign documents on the electronic platform. This representation digital certificate feature eliminates the risk of the proposal disqualification for lack of official document attached, or by error on the correlation between the signature and the official document which attests the representation. This solution implies less risk.

The solution recommended by Vortal is that all members of the consortium give power of attorney to the leader of the consortium to sign the proposals on behalf of the consortium. This proxy must be attached to the proposal at the time of submission and the proposal must be signed on the platform by a user of the consortium leader, empowered to represent the entity.
